I hope you are doing well in these difficult times of DOJ intervention and a soaring murder rate.
When a D.A. uses the media to assess Judges by such means as number of trials and hours worked, he may not be factoring in that his A.D.A.s partly control those results.
For example, if an A.D.A. pursues a no merit case to trial, the Judge’s entire day is shot trying this anemic case. A whole jury is wasted as well. During such a trial, the Judge may bend over backwards to accommodate the defense, while shutting down the A.D.A.’s motions from the get go.
If you are going to count a Judge’s effectiveness publicly by how many trials they hold or how many days they show up, realize your A.D.A.s may have a large part in how the day may be spent. This is only one factor determining how the Judge’s day is spent at work.
